Promulgated on December 28, 2000 FuJingZi#8953898 Decree
Article 1 Kinmen County Government of Fujian Province enacts this ordinance to encourage crime prevention amongst the people by providing aids to any member of the public who suffers from injuries or death whilst assisting the police in the arrest of an offender within the jurisdiction of this county.
Article 2 The competent authority for this ordinance is Kinmen County Police Bureau (hereinafter referred to as the Police).
Article 3 Assisting the police in the arrest of an offender as set forth in this ordinance denotes a person with one of the following behaviors:
1. Provides assistance during the police’s arrest of an offender, a current offender, a wanted criminal or chase of run-away offenders.
2. Take the initiative to arrest a current offender and has been ascertained to be true.
Article 4 Where the member of the public assists the police in the arrest of offenders and as a result suffers from injuries or death, aid will be provided in accordance with the following rules:
1. Death: A relief payment of NT$3 million will be paid out in addition to a funeral allowance with an upper limit of NT$500,000.
2. Disabled person: Medical costs will be paid in full and aid will be provided in accordance with the following rules:
(1) Vegetable: Consolation money of NT$3 million will be paid out in addition to a monthly living allowance of NT$50,000.
(2) Extremely severe disability: Consolation money of NT$2.5 million will be paid out in addition to a monthly living allowance of NT$10,000 to NT$30,000.
(3) Severe disability: Consolation money of NT$2 million will be paid out.
(4) Moderate disability: Consolation money of NT$1.5 million will be paid out.
(5) Light disability: Consolation money of NT$1 million will be paid out.
3. Injured person: Medical costs will be paid in full and a consolation sum of NT$20,000 to NT$300,000 will be paid out.
Where the person in Paragraphs 2 and 3 is injured or disabled and died within a year, the relief payment will be made up and funeral allowance paid out. Or where the injury or disability deteriorated to the state prescribed in Sub-paragraph (1) or (2) of Paragraph 2, consolation money will be made up according to the respective criteria and living allowance paid out thereto starting from the date of deterioration.
With regards to Sub-paragraph (1) or (2) of Paragraph 2 where a living allowance is given to the vegetable and the extremely severely disabled, payment will stop when they recover and become severely disabled or are deceased. Where a vegetable recovers and becomes extremely severely disabled, his/her living allowance will be paid out in accordance with the payment given to extremely severely disabled starting from the date of the recovery.
Article 5 The deadlines and procedures for claiming relief payment, funeral allowance, medical allowance, consolation money, and living allowance as prescribed in the previous Article are as follows:
1. Deadlines:
(1) Applications to claim the relief payment, consolation sum, and living allowance must be filed within six months from the date the injury or disability or death takes place. Overdue applications will not be accepted. However, this is not applicable where there is a special circumstance.
(2) The person claiming the medical allowance shall apply within two months from the date the incident takes place. Overdue applications will not be accepted. However, this is not applicable where a medial institution has given proof that longer treatment is required for recovery and extension is approved within the prescribed deadline by the Police upon notification.
2. Procedures:
(1) The application for medical allowance, consolation money and living allowance must be affixed with the signature of the injured or disabled person himself/herself (not applicable to vegetables).
(2) The collection of relief payment shall be conducted in accordance with related regulations in inheritance in the Civil Code.
(3) The funeral allowance shall be collected by the person who actually spends it.
(4) When claiming relief payment, funeral allowance, medical allowance, consolation money, and living allowance, an application from must be filled out together with relevant documentation of proof, receipts of expenses, medical certificate or appraisal of disability degree or death certificate, and sent to the police authority handling the incident for approval.
Article 6 For allowances set forth in this Ordinance, the Police shall budget annual sums to pay out in accordance with the budgeting procedures.
Article 7 This Ordinance is applicable to aliens.
Article 8 The forms and respective formats required by this Ordinance will be set up by the Police.
Article 9 This Ordinance will come into effect on the day of promulgation.
